Last week, the California Community Care Licensing Division (CCLD), Care Provider Management Bureau (CPMB) released updated guidance on the process for transferring a criminal record clearance or exemption from one Home Care Services organization to another.
Effective January 1, 2023, SB 1093 amended HSC section 1796.24 for Home Care Services to allow an individual to request a transfer of a criminal record clearance or exemption on a form provided by the Department or via the Department’s secure online portal, removing the limitation that the home care organization applicant or home care organization licensee make the request.
Prior to the change, licensees and applicants had to request a transfer in writing and had to submit a copy of the individual’s driver’s license, a valid identification card issued by the Department of Motor Vehicles, or, if the individual was not a California resident, a valid photo identification issued by another state or the U.S. government.
